These terms are the agreement between you and DELAI LLC ("DELAI", "we") for the use of Pop My Orbs. By tapping Accept or by playing the game you accept them. If you do not accept them, do not use the app.
Pop My Orbs is a puzzle game. You place pieces of Orbs on a board, clear full rows and columns, and chase a high score. It is entertainment only.
We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial entertainment, under these terms and the rules of the app store you got it from.
The app shows advertising. You may choose to watch a rewarded video to continue a game after it ends. Watching is always optional, and a reward is only given when the video completes.
Ads are provided by third parties. We do not control their content and are not responsible for products or services they offer.
Orb packs change how the game looks, never the rules or the scoring. Packs are currently free. If we ever sell anything in the app, the price and what you get will be shown before you buy, and purchases will be handled by your app store.
Scores, Milestones and other game content have no monetary value and cannot be exchanged for money.
Your progress, scores and settings are stored only on your device. Deleting the app deletes them. We cannot restore them because we never had a copy.

The app is provided "as is" and "as available". To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error free.
To the fullest extent the law allows, DELAI is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, data or goodwill. Our total liability arising out of or relating to the app is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty-five US dollars.
Nothing in these terms excludes liability that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.
We may update these terms. We will change the date at the top, and for material changes we will ask you to accept them again in the app.
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules.
