AnteUp Terms of Service

These terms are the agreement between you and DELAI for the use of AnteUp. By creating an account or using the app you accept them. If you do not accept them, do not use the app.

1. What AnteUp is

AnteUp is a tool for making one better decision. You place an Ante: an activity you commit to for a set number of minutes, in exchange for time in an app you choose to shield. If you complete the activity, the app unlocks for the minutes you earned.

2. Your account

• You must be at least 13 years old, or the minimum age of digital consent where you live, whichever is higher.
• You are responsible for what happens under your account and for keeping your credentials safe.
• One person per account. Do not share it.
• Give us accurate information. The time zone in particular determines when your day ends, and a wrong one will make the app behave incorrectly.

3. The shield, and its limits

The shield uses Apple's Screen Time controls. Those controls are provided by iOS, not by us.

• You choose which apps to shield. We do not choose for you and we cannot see which you chose.
• You can remove the shield at any time through iOS Settings. AnteUp is a commitment you make to yourself, not a lock we hold the key to.
• We do not guarantee the shield will work in every case. Operating system changes, permissions being withdrawn, or Apple's own behaviour can prevent it.
• Folding an Ante ends the shield immediately and records a missed decision. Nothing is deducted, and nothing carries over to the next day.

4. How Antes are settled

Whether an Ante is won is decided by us, against our own clock, and where relevant against the health readings you have authorised. The device does not get to declare a win. This is deliberate: a number that can be edited by the person it describes is not worth having.

We may refuse to settle an Ante as won where we reasonably believe the result was fabricated or the app was manipulated.

5. Free and Premium

We may change what is included in each tier. If we materially reduce what a paid tier includes, we will tell you before it takes effect, and you may cancel.

6. Subscriptions, billing and cancellation

• Subscriptions are sold and billed through your Apple App Store account, not by us directly.
• Payment is taken when you confirm the purchase, and again at each renewal.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• To cancel, go to iOS Settings → your name → Subscriptions. Deleting the app does not cancel a subscription, and neither does deleting your AnteUp account.
• Cancelling stops the next renewal. It does not end the period you have already paid for, and it does not produce a partial refund.
• Refunds are handled by Apple under its own policy. We can ask on your behalf but we cannot issue them.
• Prices may change. We will give you notice, and a price change never applies to a period you have already paid for.

7. Advertising

Free accounts see advertising. Ads never appear on the Ante Won screen, never follow a fold, and there is at most one per completed Ante. We do not use your health data for advertising and we do not share it with advertisers.

8. Acceptable use

Do not:

• Fake, automate or manipulate Ante results, including tampering with health data
• Attempt to access another person's account or data
• Reverse engineer, probe or attack the service, or exceed reasonable request volumes
• Use the app to harass anyone, or for anything unlawful

We may suspend or close an account that does any of these.

9. Your data

What we collect and why is set out in the Privacy Policy, which forms part of these terms. You keep ownership of the content you enter. You grant us the licence necessary to store and process it in order to run the service.

10. Ending it

• You may delete your account at any time from inside the app. Deletion is immediate and permanent, and there is no copy.
• We may suspend or end your access if you breach these terms, or if we stop offering the service. If we stop offering it, we will give reasonable notice and refund any unused prepaid period.

11. Warranties and liability

The service is provided "as is" and "as available". To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error free, or that it will change your behaviour.

To the fullest extent the law allows, DELAI is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, data or goodwill. Our total liability arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty-five US dollars.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.

12. Changes to these terms

We may update these terms. We will change the date at the top, and for material changes we will tell you in the app. Continuing to use AnteUp after a change means you accept it.

13. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules, and the courts located there have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live.

14. Apple

Apple is not a party to these terms and has no obligation to provide support for AnteUp. Apple is a third-party beneficiary of these terms and may enforce them against you. Your use of the app must also comply with the Apple Media Services Terms and Conditions.
